LAST WILL AND TESTAMENT
MAHLON HESTON
DATED: February 6, 1884
Date of Death: March 18, 1884
IN THE NAME OF THE BENEVOLENT
FATHER OF ALL:
I, MAHLON HESTON of East Township, Carroll Co Ohio, do make and
publish this my last will and testament.
ITEM FIRST. I give and bequeath to my beloved wife, JANE HESTON,
one third of my personal property, moneys, credits and real estate
being one third of the farm on which we now reside, during her
natural life or so long as she shall remain my widow.
ITEM SECOND. I give and bequeath to:
My daughter, ANGELINE LONG, Three Hundred and Fifty Dollars.
My granddaughter, CYNTHI ADELINE BALL, One Hundred and Fifty
Dollars, and
My granddaughter, ELIZA ELLEN BALL, One Hundred and Fifty Dollars,
and to my son, JOHN HESTON, one two-year-old colt.
ITEM 3. The remainder of my estate I give equally to my four
children, ELIZABETH HESTON, JOHN HESTON, JESSE A. HESTON AND IDA MAY
HESTON.
Also, at the death or intermarry of my said wife, JANE HESTON, the
One Third above bequeathed to her shall be equally divided between
my four children, ELIZABETH HESTON, JOHN HESTON, JESSE A. HESTON and
IDA MAY HESTON,
It is my desire that the farm on which we now reside – being about
seventy-four acres in East Township, Carroll Co O. be not
sold at my death, and that my said wife, JANE HESTON, and my four
children, ELIZABETH HESTON, JOHN HESTON, JESSE A. HESTON AND IDA MAY
HESTON, shall pay to
ANGELINE LONG, Three Hundred and Fifty Dollars, to
CYNTHI ADELINE BALL, One Hundred and Fifty Dollars; and to
ELIZA E. ELLEN BALL, One Hundred and Fifty Dollars
Provide my wife, JANE HESTON, and my children, ELIZABETH HESTON,
JOHN HESTON, JESSE A. HESTON and IDA MAY HESTON, shall have eight
years in which to make said payment to said ANGELINE LONG, CYNTHI
ADELINE BALL and ELIZA ELLEN BALL.
I hereby nominate my wife, JANE HESTON, and my son, JOHN HESTON,
Executors of this my Last Will and Testament, and I do not wish them
to be required to give Bond for so acting.
IN WITNESS WHEREOF, I have hereunto set my hand and Seal this Sixth
day of February, A.D.1884. Inter________ in regards to John

CODICIL
Dated: March 4, 1884
I,
MAHLON HESTON of East Township, Carroll County, Ohio, do make and
publish this codicil to my Last Will and Testament.
ITEM 4: I give and bequeath to my son, JESSE A. HESTON, a colt if
there be one on my premises at the time of my death and if not, then
my son John shall pay Jesse Fifty Dollars, this being half the value
of the colt bequeathed above to John. Jesse shall not come into
possession of the above-bequeathed colt until his majority, but said
colt shall be kept on the premises until he is entitled to it.
It is my will and desire that there be no appraisement and no sale
of my personal property and that the same may remain for the use of
my widow and my four above-named children.
In witness whereof I hereunto set my hand and Seal this 4th
day of March, A.D. 1884.
