LAST WILL AND TESTAMENT
SETH BALL
Will Dated: January 6, 1911
Death Date: 27 October 1911
I, SETH BALL, of the town of Augusta, County of Carroll, State of
Ohio, being of sound and disposing mind and memory, do hereby make,
publish and declare this to be my LAST WILL AND TESTAMENT, hereby
revoking any, each and every last will and testament that I may have
heretofore made, published and declared.
ITEM 1ST: It is my will that all my just debts and
funeral charges be paid from my estate as soon after my death as the
same can be done without loss to my said estate.
ITEM 2ND. I give and bequeath to the TRUSTEES OF THE
DISCIPLE CHURCH AT AUGUSTA, CARROLL CO., OHIO, their successors in
office the sum of SEVENTY-FIVE ($75.00) DOLLARS to be used by them
for the purpose or use of said Disciple Church, on the condition
that said Church cause to be expended the sum of FIVE DOLLARS
annually in the month of May in keeping in good order the burial lot
on which reposes my body and the body of my beloved wife, Jascintha
Ball.
ITEM 3RD. If the same has not already been provided for
during my life, it is my will that the executor of this my last will
and testament cause to be erected at the proper place on the burial
lot upon which my body and the body of my said wife are buried a
suitable monument at a cost not less than TEN HUNDRED ($1,000,00)
DOLLARS, nor more than FIFTEEN HUNDRED ($1,500.00) DOLLARS.
ITEM 4TH. I give, bequeath and devise to my said beloved
wife, JACINTHA BALL, in lieu of her dower in my estate of which I
may die seized, all the residue of my estate, real, personal, and
absolutely and unconditionally.
ITEM 5TH. In case I shall survive my said beloved wife,
Jacintha Ball, then it is my will, and I bequeath, devise and so
direct that at my death the residue of my estate after the payment
of my said debts and funeral expenses and the payment of the said
sum named in Item 2, and the erection of the monument named in Item
3 above, if said monument has not been arranged for during my life,
shall be, and I bequeath and devise as follows from the said
residue: That there be paid to:
My brothers, F. M. BALL and T. D. BALL, each, the sum of ONE HUNDRED
($100.00) DOLLARS;
My nephew, WILLIAM DAVIS, the sum of TWO HUNDRED AND FIFTY ($250.00)
DOLLARS;
My nephew, ELGIE HESTON, the sum of FIVE HUNDRED ($500.00) DOLLARS;
My nephews, GEORGE BALL and RAYMOND BALL, each, the sum of ONE
HUNDRED ($100.00) DOLLARS;
HENRY W. PERMAR, THE SUM OE ONE HUNDRED AND FIFTY ($150.00) DOLLARS;
My nephew A. C. BALL, the sum of ONE HUNDRED ($100.00) DOLLARS;
E. C. NORRIS and REBECCA SNOWDEN, each, the sum of ONE HUNDRED
($100.00) DOLLARS;
EMMA PERMAR, ELLA LAFFERTY, PAUL D. RACH, and ARTHUR B. HESTON,
each, the sum of FIFTY ($50.00) DOLLARS;
JESSE BETTIS (son of Etta Bettis) the sum of FIFTY ($50.00) DOLLARS
and my book case; and
That THE BALANCE OF WHAT REMAINS, if any, shall be paid to ELGIE
HESTON of Mechanicsville, Iowa.
ITEM 6TH. Reposing implicit confidence in A. H. Myers,
of Augusta, Ohio, I nominate and appoint him EXECUTOR of this my
LAST WILL AND TESTAMENT, hereby authorizing and empowering him to
compromise, adjust, release, and discharge, in such manner as he may
deem proper, the debts and claims due me, and to perform all things
necessary to carry out this my LAST WILL AND TESTAMENT.
IN WITNESS HEREOF, I have hereunto set my hand to the foregoing
instrument as my LAST WILL AND TESTAMENT, this 6th day of
January, in the year 1911.
